Definitions

The words or phrases described below shall have the following meaning wherever used in this Policy.

Insured/You/Your

The person, company or partnership who has purchased Digital System insurance as described in this Policy.

Digital System

The items as specified on your Policy Certificate.

Period of Insurance

The Insurance starts 14 days from the date of purchase for the period agreed as per your policy documentation. Your premium payments will continue by periods of one month, quarterly or annually as agreed for a minimum 12 month period. Thereafter your payments will be ongoing unless you choose to cancel them. The monthly, quarterly or annual premium will be collected by Direct Debit, Credit/Debit Card by Sat Insure Ltd. This Insurance will terminate immediately if the Insurer does not receive your monthly, quarterly or annual premium in advance.

Territorial Limits

Mainland United Kingdom only.

Breakdown

In the event of a breakdown or accidental damage resulting in a breakdown: We shall provide a repair service or replacement for the insured product.

Repair or Replacement

If we decide your product cannot be repaired or is uneconomical to repair we may replace it with the same model. Should that model no longer be available we may at our option provide an alternative of similar specification and quality.

Claims Procedure

Claims, In the event of a claim you must contact the Diagnostics Centre (DC) on the number shown as soon as possible. These telephone calls may be recorded. If you make a claim, it may prejudice such claim if any information you or your family supply is false, fraudulent or otherwise incorrect.

Claims Service

It is always the intention to provide you with a first class service when you make a claim. However, if you are not happy with the service please in the first instance write to the Manager of the Diagnostics Centre. If you are not satisfied with the response you may then write to the Managing Director at the Administration Office. If still dissatisfied write to the Claims Manager at AmTrust International Underwriters Limited, PO Box 10534,Dublin 2,Ireland to review your case and ultimately you may contact the Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR.

Law

This Insurance shall be subject to English Law.

General Conditions

What this Policy does not cover

• Routine maintenance, cleaning and servicing.

• Equipment still covered by any manufacturer's warranty.

• Equipment that has been subject to unauthorised modification or upgrade not authorised or approved by the manufacturer.

• Your failure to follow the operating instructions in relation to the Equipment.

• Use of the Equipment in a non-domestic or any commercial environment.

• Use for hiring.

• Malicious or intentional damage to the Equipment by any persons whatsoever.

• Equipment recalled by any supplier or manufacturer for any reason, including generic manufacturers’ defect.

• Any damage to the equipment caused by theft, fire, explosion, dampness, liquid spillage or foreign bodies inside the receiver box. Note: These may be covered by your household contents policy.

• Faults which were in existence before you made this Policy.

• Replacement of any item that is intended to be replaceable such as fuses and batteries.

• Damage or loss of programmes saved on any hard drive.

• Damage to components of any televisions or viewing monitors including High Definition.

• Damage to any equipment that is not part of the schedule of equipment but is connected to it, such as a communal reception dish or distribution system, broadband or Wi-Fi equipment.

• Loss or interruption of service due to obstacles within line of sight e.g. building development, or when a tree grows taller and gets in the way of the signal to your dish - particularly relevant when in leaf.

• Faults occurring due to your satellite provider updating your software system.

• Costs due to rust, corrosion or water damage. Wear and tear or gradual deterioration, condensation, dust or change in temperature, gradually developing defects, cracks, flaws or fractures, scratching, chipping, abrasion, change of colour, texture or finish.

• Loss of any subscriptions paid.

Cancellation

In addition to your statutory rights, you may cancel this insurance at any time after the minimum 12 month period by giving notice of cancellation, in writing or by telephone: Sat Insure Ltd, Ultralase House, The Avenue, Cliftonville, Northampton, NN1 5BT Tel: 0845 450 5271

Cover will continue until the end of the month in which you are cancelling. The Insurer reserves the right to cancel this Insurance by giving 30 days written notice.

During the Cooling Off Period

Under the Consumer Protection (Distance Selling) Regulations 2000, in line with FSA guidelines we have extended the right to automatic cancellation to 14 days.

During the Term of the Policy

You may terminate the Policy by giving us fourteen days notice in writing subject to the following conditions.

If You Have Made No Claim

• Notice will be accepted as fourteen days from the receipt of your notification – this will be taken as your Notice to Cancel date. The termination of the Policy for the purposes of any refund due will be calculated as at the end of month of Notice to Cancel date, i.e. Refunds will be paid based on whole months only.

• If you cancel before the end of the initial term of the Policy and we have not provided any replacement/repair service you will be entitled to a refund of the pro-rata charges for the balance of the Term, i.e. if you have paid for twelve months and your Notice to Cancel date is during month ten you will be entitled to a refund of the two months charges (1/6 of the total paid).

• There will be a minimum administration charge of £25.00 for cancellation at any time after the cooling off period, i.e. if you pay in full and cancel in month two, we will deduct £25 from the total monies received. If you pay by Direct Debit and cancel before we have received at least £25.00 you will be liable to pay the balance up to that amount.

If You Have Made a Claim

• If you cancel the Policy prior to the end of the initial Term and have received repair or replacement services at any time we reserve the right to make reasonable charge for the service provided to date and you may be liable for the balance between charges due and monies already received under your payment schedule.

• If We Cancel the Policy: If you have paid in full for the initial Term of the Policy you will be given fourteen days notice and a refund will be made for the whole months’ proportion of the Policy still to run. If you fail to pay according to the agreed payment schedule, provision of service may be suspended at our discretion and you will be liable for payment up to that proportion of the Policy Term. We will give you notice at your address set out in the Policy Certificate.

• Reasonable Precautions: You must take all reasonable steps to minimise the Insurer’s liability.

Your Statutory Right Of Cancellation

You have a right to cancel this insurance by giving notice of cancellation within fourteen days of the receipt of Confirmation of Insurance Cover to the Administration Office in writing at Northampton or by calling 0845 450 5271. If you do not exercise this right to cancel then your rights and those of the Insurer to cancel this insurance cover thereafter are set out in the General Conditions above.

Data Protection Act 1998

Any details you supply will be held by Sat Insure Ltd Limited and AmTrust and their administrators who will have access to the details only for the purpose of administrating your policy. These details will not be kept for longer than necessary.

We may use the information that you provide us with to send you details of products services and promotions offered by SatInsure Ltd.

Amending This Policy: We reserve the right to make reasonable changes to this Policy (including any change to the Amounts due) on giving you notice in advance. Any change to the Amount will not apply until after the initial Term.

Exclusion of third party rights: This Policy is for your benefit only and any permitted transferee. No rights or benefits are given to any third party and the provisions of the Contracts (Rights of Third Parties) Act 1999 do not apply to this policy.
